Terms of Service

Please read these Terms of Service carefully before booking any tour with Debyani Tours & Travels. By making a booking or using our services, you agree to be bound by these terms. If you do not agree, please do not proceed with a booking.

1. Acceptance of Terms

By accessing our website at debyanitours.net or engaging Debyani Tours & Travels for any service, you confirm that you are at least 18 years of age (or booking on behalf of a group with authority to do so) and that you accept these Terms of Service in full. These terms apply to all tours, packages, and services offered by Debyani Tours & Travels.

2. Services

Debyani Tours & Travels provides pilgrimage and leisure tour packages to Nepal, including but not limited to:

• Muktinath tours by flight, helicopter, and road
• Pashupatinath, Lumbini, Janakpur, and Nepal Char Dham yatra packages
• Senior citizen and group pilgrimage packages
• Custom itinerary planning and travel arrangements within Nepal

We act as a tour operator and coordinator. Certain components (flights, hotels, helicopter services) are provided by third-party suppliers operating independently.

3. Booking & Payment

• Booking Confirmation: A booking is confirmed only after we issue a written confirmation (via email or WhatsApp) and a booking deposit is received.
• Advance Payment: A deposit (typically 30–50% of the total tour cost) is required at the time of booking to secure your dates and arrangements.
• Full Payment: The remaining balance must be paid in full no later than 7 days before your departure date, unless otherwise agreed in writing.
• Payment Methods: We accept bank transfers, UPI, and other methods as communicated during booking. All prices are quoted in INR or NPR as applicable.
• Price Changes: Quoted prices are fixed at the time of confirmation. We reserve the right to adjust prices for new bookings due to fuel surcharges, currency fluctuations, or government-imposed levies.

4. Travel Documents

• All travelers must carry a valid passport or government-issued photo ID (Aadhaar card or Voter ID accepted for Indian nationals) for the duration of the tour.
• Nepal Visa: Citizens of India do not require a visa to enter Nepal. Citizens of other nationalities are responsible for obtaining the appropriate visa before travel. We can provide guidance but cannot process visas on your behalf.
• Travelers are responsible for ensuring their documents are valid and up to date. Debyani Tours & Travels bears no responsibility for denied entry due to incomplete or invalid documentation.

5. Health & Fitness

• Travelers are solely responsible for ensuring they are physically and medically fit for their chosen tour, particularly for high-altitude destinations such as Muktinath (3,710 m above sea level).
• Altitude Risk: Altitude sickness (Acute Mountain Sickness) is a real risk at high elevations. We strongly advise consulting a physician before travel and following acclimatisation guidelines.
• Any pre-existing medical conditions that may affect participation — including heart conditions, respiratory conditions, or mobility limitations — must be disclosed to us at the time of booking so we can plan appropriate arrangements.
• Debyani Tours & Travels reserves the right to decline or curtail participation of any traveler whose health condition poses a risk to themselves or others.

6. Itinerary Changes

We reserve the right to modify itineraries at any time in the following circumstances:

• Adverse weather conditions, including monsoon, snowfall, or visibility issues
• Road closures, landslides, or infrastructure disruptions
• Political unrest, strikes (bandhs), or government directives
• Force majeure events (natural disasters, pandemics, etc.)
• Flight or helicopter schedule changes made by the airline or operator

Where itinerary changes occur for these reasons, we will make every effort to offer an equivalent alternative. No additional charges will apply to the traveler for substitutions of equal value, but refunds for unused services may be limited by third-party supplier policies.

7. Liability

Debyani Tours & Travels acts as an intermediary between travelers and independent suppliers (hotels, airlines, helicopter companies, guides). Our liability is limited accordingly:

• We are not liable for delays, cancellations, or service failures caused by airlines, hotels, or other third-party suppliers.
• We are not liable for personal injury, illness, death, property damage, or financial loss arising from natural disasters, extreme weather, political events, or the actions of third parties.
• Our liability for any claim arising from our own negligence is limited to the total amount paid for the tour in question.
• Travelers participate in all activities at their own risk, particularly trekking, high-altitude travel, and helicopter tours.

8. Travel Insurance

We strongly recommend that all travelers purchase comprehensive travel insurance before departure. Your policy should ideally cover:

• Trip cancellation and curtailment
• Medical expenses and emergency evacuation (including helicopter evacuation at altitude)
• Loss or theft of baggage and personal belongings
• Flight delays and missed connections

Please note that helicopter evacuation costs are not included in our tour packages unless explicitly stated in writing. Emergency evacuation from high-altitude areas can be extremely expensive without appropriate insurance coverage.

9. Photography & Media

Photographs and videos taken by Debyani Tours & Travels staff or our associated guides during tours may be used for marketing purposes, including on our website and social media channels. If you do not wish your image to be used, please notify us in writing before or at the commencement of your tour. We will respect all such requests.

10. Cancellation & Refunds

Cancellation and refund terms are governed by our Cancellation & Refund Policy, which forms part of these Terms of Service and should be read in conjunction with this document.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Nepal. Any disputes arising out of or in connection with your booking shall be subject to the exclusive jurisdiction of the courts of Nepal. We will always endeavour to resolve disputes amicably before any formal proceedings.
